Terms of Service

Welcome to Gallery Cleaning. These Terms of Service ("Terms") govern your access to and use of the Gallery Cleaning mobile application (the "App") provided by Gallery Cleaning ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using Gallery Cleaning, you confirm that you are at least 13 years of age and that you have read, understood, and agree to be bound by these Terms. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of the App

Gallery Cleaning is a mobile application designed to help users organize and clean their photo library. The App allows users to review photos using a swipe-based interface — swipe right to keep a photo and swipe left to mark it for deletion. The App operates entirely on your device and does not upload your photos to any external servers.

3. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse-engineer, decompile, or disassemble the App or attempt to extract its source code.
• Use the App for any illegal, unauthorized, or harmful purpose.
• Remove or alter any proprietary notices, labels, or marks on the App.
• Use automated systems, bots, or scripts to access or interact with the App.

4. User Responsibilities

You are solely responsible for:

• Your photos: Decisions made within the App regarding which photos to keep or delete are your responsibility. We recommend reviewing your selections carefully before confirming deletions.
• Backups: Maintaining adequate backups of your photos and data. While deleted photos are moved to your device's "Recently Deleted" folder (where they can typically be recovered for 30 days), we are not responsible for any data loss.
• Device security: Keeping your device and its operating system up to date and secure.

5. Photo Deletion

When you use Gallery Cleaning to delete photos, those photos are moved to your device's native "Recently Deleted" album. They are not permanently deleted immediately. Your device's operating system will automatically and permanently remove them after approximately 30 days, unless you manually recover or permanently delete them sooner.

Important: We strongly recommend reviewing the "Recently Deleted" folder after using the App to ensure no photos were accidentally marked for deletion.

6. Intellectual Property

All rights, title, and interest in and to the App — including but not limited to the design, graphics, text, software, code, and all other content — are and remain the exclusive property of Gallery Cleaning and its licensors. These Terms do not grant you any rights to our trademarks, service marks, logos, or trade names.

7. App Store Terms

If you downloaded the App from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the App as downloaded from the Apple App Store.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• Any defects will be corrected.
• The App will meet your specific requirements or expectations.
• The results obtained from the use of the App will be accurate or reliable.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GALLERY CLEANING, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the App.
• Any unauthorized access to or alteration of your data.
• The deletion of photos or any data loss, whether accidental or intentional.
• Any other matter relating to the App.

10. Indemnification

You agree to indemnify, defend, and hold harmless Gallery Cleaning and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

11. Updates and Modifications

We may update, modify, or discontinue the App (or any part of it) at any time, with or without notice. We may also update these Terms from time to time. The updated Terms will be effective upon posting. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your license to use the App will immediately cease. You may also terminate these Terms at any time by deleting the App from your device.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Gallery Cleaning operates, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gallery Cleaning regarding your use of the App and supersede all prior agreements, understandings, and communications.
